Q.What is H-3 visa?
A.The H-3 visa allows foreign nationals to come to the U.S. to receive specialized instruction and training from a U.S. company. The training to be received in the U.S. must be unavailable in individual's home country in areas such as commerce, agriculture, government, professions, finance, agriculture, or in an industrial establishment. In addition, the applicant must show that the training will further his/her career in their home country. A person is able to work on an H-3 visa, but the work must be incidental to their training. Special Exchange Visitors, one who seeks to enter the U.S. to gain practical training in educating children with physical, mental, or emotional disabilities may also apply for under the H-3 category. To get an H-3 visa, you need a specific offer from a qualified company in the U.S.
Q.What are the limitations of H-3 visa ?
A.
  • The sponsoring U.S. Company must offer the training program.
  • H-3 visa is not available for graduate medical education and training.
  • The H-3 visa holder may not change his/her status if the H-3 visa holder remains in the U.S. for the maximum period of allotted time, until (s)he has resided outside of the U.S. for a period of six months.
  • The H-3 visa holder may not apply for a extension of status and will have to leave the country upon the completion of the period of stay.
Q.What can I do on H-3 visa?
A.
  • Enter into the U.S. and get trained in a professional capacity for a temporary period up to 2 years.
  • Travel in and out of the U.S. freely till the validity of your visa.
  • Get your dependents to stay with you in the U.S. on H-4 visa.
  • Your dependents may join U.S. schools, colleges and universities on H-4 visa, and do not need separate student visa.
  • H-3 visa holder is also allowed to take few credits at a University which support the training program
